IRREGULARTIES IN PF AC HOW TO ACT SIR

DEAR SIR,

WE ARE 25 TEACHERS AT POLICE MODERN SCHOOL, LUCKNOW WORKING IN THE TGT GRADE AND HAVE BEEN PERMANENT TEACHERS FROM 1998.

ONLY FROM APRIL 2009 THE COLLEGE STARTED DEDUCTING PF SUMS FROM OUR SALARIES AND THE SYSTEM IS CONTINUING.

HOWEVER THE SCHOOL DID NOT SEND THE FUNDS TO PF OFFICE AND KEPT WITH THEM. NO STATEMENT, NOMINATION FORM PF NO WAS ASSIGNED TO US.

WE CAN ONLY PROVE FROM OUR SALARY STATEMENTS THAT PF DUES WERE DEDUDCTED.

TO OUR HORROR THE TOTAL DEDUCTED AMOUNT FROM EACH TEACHER WAS DIRECTLY CREDITED BACK TO THEIR SB ACS ON SEP 18,2009 BY THE PRINCIPAL WITHOUT ASSIGING ANY REASON.

WE PROPOSE TO PROTEST THIS ACTION IN WRITING ON SEP 20 WHEN SCHOOL REOPENS.

KINDLY GUIDE US IN THE MATTER.

THE SCHOOL HAS ACTED IN A VERY HIGH HANDED MANNNER IN THE PAST AND OBEYS ON RULES.

Whatever acts/misdeeds have been committed by college in past has no relevance with the present matter. This time college administration and Principal have committed criminal offence. College has committed offense punishable under section 406/409 IPC. You all not only can file a criminal case/FIR against the administration of college but also against the signing authority Principal but can also move a representation to EPFC of your area who has got civil court powers in this regard and who can order recovery of the entire amount with penal interest and damages.

I am strange to know that you have been provided with the benefit of EPF with effect from 1998 whereas all the educational institutions of India had been covered under EPF scheme with effect from August 1982. You make representation to this regard to EPF authorities who shall recover the arrears from 8/82 till to date with penal interest and shall credit in the accounts of all of you and shall provide separate account numbers and detail of statement of accounts.

REGARDING THE PF DEDUCTIONS KINDLY NOTE THAT.
1.KINDLY NOTE THAT PROVIDENT FUND AMOUNT DEDUCTED FROM SALARY IS TO BE TRANSFERED TO P.F.A/C OF THE EMPLOYEE AND TO BE SENT TO P.F.OFFICE.
2.IN YOUR CASE IT WAS NOT SENT AND REFUNDED BACK TO ALL EMPLOYEES.
3.KINDLY NOTE THAT YOU ALL ARE PERMANENT STAFF AND KINDLY KEEP PATIENCE AND DO NOT TAKE DIRECT WAR WITH THE MANAGEMENT.IT IS IN YOUR OWN INTEREST AND IN THE INTEREST OF YOUR FAMILY.
4.YOU MAY PEACEFULLY MAKE A REPRESENTATION AND REQUEST FOR STARTING P.F.DEDUCTIONS FROM THE SALARY.THERE MAY BE SOME GENUINE PROBLEMS OR DIFFICULTIES FACED BY THE MANAGEMENT.YOU ALL KINDLY AVOID DIRECT FIGHT WITH THE MANAGEMENT.AND TRY TO RESOLVE THE ISSUE PEACEFULLY.
5.I HAVE HANDLED SEVERAL SERVICE MATTERS, MANAGEMENT IS FINANCIALY STRONG AND EMPLOYEES ARE NOT THAT STRONG FINANCIALY AND MENTALY TO FIGHT LEGAL BATTLE.WHICH MAY PROLONG AND ULTIMATELY RESULLT IN LOSS OF INCOME AND LOSS OF JOB OF EMPLOYEES AND EVEN SOME FINE TO MANAGEMENT.
6 KINDLY NOTE THAT DO NOT SPOIL YOUR FUTURE STEADY INCOME AND PEACEFUL FUTURE LIFE .THINK OF YOU YOUR FAMILY AND FINANCIAL RESOURCES AND AVOID DIRECT CLASH WITH THE MANAGEMENT.
7 YOU MAY POLITELY MAKE AN APPLICATION AND SEND YOUR SUGGESTIONS TO THE MANAGEMENT AND WITH MUTUAL HELP RESOLVE THE DISPUTE.PLEASE NOTE.

but is it necessary for the staff to be 20 or more before ded can be made from aug 82.

is that condition a must?

we are working for a school affliated to the cbse board and run by a society of the u.p police department for welare of wards of police personnel
