claim without nomination

(Querist) 13 January 2011 This query is : Resolved 
My father died in Oct'10. He had a Savings a/c & an FD in Bank of Baroda, both without nomination. When we contacted the bank manager for claim, he said that they would require Legal Heirship Certificate for the same. We applied for it in DM's office & got it within one month. When we contacted the bank manager again, along with the above certificate, he said that he will require Succession Certificate as he is authorized to process the claim on the basis of Legal Heirship Certificate. What should I do now?

Apply for Succession Certificate in the court of the Distrct Delegate. This is the most authentic proof of heirship of a deceased relating to his moveable properties.

The appropriate thing will be to take a succession certificate.

The need of succession certificate shall be depends upon the amount. Ask the claim form from the bank. The requirements shall be mentioned in the form.

Bank is entitled to settle the claims based on Legal Heirship certificate by obtaining consent letter from every member. Succession Certificate will be insisted only when there is dispute between legal heirs.

If the amount in savings a/c & FD is Rs.12lacs cumulatively, what would be the court fees for obtaining Succession Certificate in Uttar Pradesh?
