Stamp Act

(Querist) 05 February 2011 This query is : Resolved
Sir , recently I got a sale deed registered before Sub-Registrar concerned.
That the sale deed was stamped as per the previous rate prevailing in the State. That on the date of registeration, after presentation of document as well report by the concerned clerk of Sub-Registrar, when document was presented before Sub-Registrar , the latter told me that I have enclosed stamp duty at excessive rate about double the earlier one, as the new law has introduced whereby rates have been changed . Document was registered and returned to the executant/Vendee.
Now I have a querry whether the excessive stamp duty can be recovered through Collector under Sec.52 of Stamp Act . If yes, then what is the mode .
Here it is pertinent to mention that the document has been duly registered before the concerned Sub-Registrar

No because stamps have been used now.
