Dear Sir ,
The company owned vehicle was driven by an employee of the company . The vehicle was insured . When accident took place the driving licence of the person driving the vehicle had expired by just 9 days . It was in a grace period of 30 days as per RTO rules . The grace period will give for the purpose of renewal of license. The accident if took place in such period, it is considered as license expired. The insurance company is not liable to pay any claim as per the rules.
Advocate. Arunagiri (Expert) 23 February 2011
The insurance company is liable to pay the insurance claim. By renewing the driving license, the license becomes a valid one with retrospective effect.

It is not the case where the license is expired and fresh license is obtained.
