Since there exist condition of one month notice or notice pay, thus you are liable to pay the same bur you have already resigned. Thus there is no use making any payment. let your employer to file suit for recovery of amount, you can offer the same in that suit, otherwise every thing is alright.

If you have been relieved officially on resignation, you can wait for the notice from the employer for making payment of salary in lieu of notice period. If you have left service at your own without a written notice and getting officially relieved, the management can treat you to have absconded from duty, which is a misconduct on the part of the employee.
So, better get your resignation regularized by writing yourself to your employer that you are ready to pay the amount, if any becomes due from you on your resignation. That way, if the employer asks you to deposit any amount in lieu of the notice period must deposit that, so that the employer may not at any time later tries to harass you in the name of your having been on unauthorized absence.
