Can a settler in a public Charitable Trust allow his premises to be used for office of Trust.

Querist : Anonymous (Querist) 17 March 2011 This query is : Resolved 
At the point of Registration of a Public Charitable Trust u/s 12AA & 80G of the ITAct 1961 , the Commissioner of IT refused to register the Trust on the ground that the Settler has allowed a part of a premises owned by him to run the Registered office of the Trust which affect the irrevocably clause of the Trust and still the settler has control over the Fund

The Commissioner is wrong by passing such opinion. He has only to see whether the Trust is genuine and object is charitable in nature.
You should file an appeal before the ITAT.
