Cheque bounce case (Sec 138 NA act)

Querist : Anonymous (Querist) 16 May 2011 This query is : Resolved
Hi,
I am a NRI and was cheated by a old friend in Inda. we filed cheque bounce cases under Sec 138 NA act. Now I am travelling to USA. Can I appoint somebody to attend the court in my absence? If yes, through some light on the procedure.
Thanks in advance.

Dear anonymous

With the permission of court a power agent can be substituted to act on behalf of the complainant. But for trial (during evidence) the complainant must appear before the court.

Thanks & regards

Since you will have to be present during the time of your examination, your advocate is equipped enough to represent you, no further attorney would be required.
Advocate. Arunagiri (Expert) 17 May 2011
I suggest you to appoint POA for this purpose.

Agree with Mr. Arunagiri in addition to Mr. Devjyoti's opinion.
Advocate Bhartesh goyal (Expert) 17 May 2011
I do agree with Mr Barman.
