Regarding Company Winding Up

I request for relevant case laws supporting the fact that when one has not been a member or a director of a company, such a person cannot be made party to the Company winding up procedure.

The facts is that a person 'X', who was approached on several occasions to become the director of the company, had refused the said offer orally. But he was sent letters requesting the payment towards the share capital and board meeting, but he ignored all, because he was sure that he is not a director. He had got the ROC list checked but his name wasn't there.But when the company was wound up, Official Liquidator, issued summons on him too.
