Sub tenant

(Querist) 23 August 2011 This query is : Resolved
Dear sir,

Our room area is 200 sq ft. In that we are using 100 sq. ft. from last 55 years and remaining 100 sq. ft. is given on rent by our room owner. We are having pagadi system.

Now our chawl is going under redevelopment, our builder say that he will give only one room after redevelopment.

Is there is any solution to this problem.

Please help.

at present you are in posession of 100 square feet area . if building goes for redevlopment all tennats should come together and bargain wuth the builder . for additional area. rent for period building is under redevlopment , penalty in case posession is delayed .

U are sharing one room with ur owner. For redevelopment purposes it will be regarded as one unit. this is on the anology of a room occupied by several persons being treated as one unit. In the case of redevelopment the builder offers extra area at the rate of specified percentage of the exisitng area of the room or falt. As such ur demand for allotmwent of two seperate rooms would not be justified or sustainable.
