498a - run away with costly belongings

Hi

My mother in law took my wife away and pretended to house owner that they were taking her back in wearing clothes but they took all my jewellery in addition to her jewellery as well with her in purse.

Now, she has filed a complaint at women cell u/s 498A and claiming that all things are with me and i have been demanding dowry and beating her from the very first day of the marriage.

I have all the evidences that will help me refute her charges but what about her jewellery allegation.

What are the options in front of women cell now, if i convinced them that we have never demanded dowry. How they will handle jewellery part.

If women cell gives report in my favor, what more actions my wife can take against me.

when did your mother in law take away all jewellery? is your wife residing with you?

did you adress any correspondence to your wife mentioning said fact?

if she had taken jewellery gifted by you to your wife , did you lodge any complaint against your mother in law?

you will in reply to complaint mention that your mother in law visited your premises and left with your wife . after your mother in law left you found jewellery missing but did not want to precipitate matters so did not take any a ction .

as fara s further actions are concerned she can lodge complaint under DV act with local magistrate , make an application for maintenance , right to stay in shared household .

My mother in law took my wife along with my jewellery on May, 2011. When i found jewellery missing, I called my wife 50-60 times but she didn't pick up my phone. I also sent her 30-40 messages within 2 days when it happened, telling her to come back house.

But instead of sending my wife back, my father in law after 5 days of her exit came along with 7-8 Gundas to my house and threatened me that i should divorce her and should not contact her further.

I got frightened and didn't complain regarding my jewellery and all.

Kindly guide how to handle this in women cell. Thanks

Just represent your side of story. Nothing to worry.
You can file a counter case u/s 406 of IPC if the jeweleries taken by her included your mother's jewellery as well.

Thanks very much. I will act on your advice.

They have written in their complaint at women cell that their 20 tolas jewellery is with me but I am sure that they don't have any bill to support that.

Can without bill even they claim same. Do police can lodge F.I.R just on the basis of their verbal claims, Will court consider their claim without any bill/proof.

bill is a required document in this perticular matter, which to be proof.
