Action against high court staff

Guest (Querist) 13 October 2011 This query is : Resolved
Some urgent applications were filed in a existing criminal case before high court.

All of these important applications were listed on the day fixed but some were placed in the file and some were not.

The applications not placed on record for hearing were found to be missing and registry could not trace them till now for more than two months.

the applications were deliberately missed.

How to initiate a sure action against the responsible persons of high court for affecting the proceedings of a criminal case ?

If you can show deliberation, a case for destruction of document in court records can be filed.

However, sometimes, a document is genuinely misplaced.

if some urgent applications have been filed and have been found missing the court would have directed the registry to make efforts to trace the ppaers .

filing complaint against high court staff will only further antoganise them . let the court take action against the staff if papers are not found

Mr. Sethi approach to the problem is more agreeable.Let the water take its own course. In case it is untraceable it would be reconstructed.

Rightly guided by Shri Ajay Sethi.
