Mhada transfer to family members after death of owner

Querist : Anonymous (Querist) 16 November 2011 This query is : Resolved
Dear Expert,

When MHADA property owner dies without a will, how can the MHADA property be transferred to all the children (in this case 5) to ensure that once the property is sold-off, everyone gets their equal share from the proceeds of the sale, without having to put trust into one another? Can there be a trust set up to do this? Please suggest !

Any help is much appreciated.

Thank You
H

Hello Mr Sethi,

No...she hasn't left any nomination or a will.

It is a bungalow in Charkop.

I though succession certificate was only required in case of dispute...correct? There is no dispute yet on the property, I just want to ensure that everybody gets their fair share without worrying about any foul play from any family members. Isn't there any other way out besides the succession certificate from the High Court?

You help is much appreciated.

Thank You,
H
