Daily or monthly rate of wages

(Querist) 16 November 2011 This query is : Resolved 
Dear Sir,

1) To calculate DAILY rate of wages, should we divide the wages by 26 for all months i.e. including FEBRUARY ?

2) To pay wages as per MONTHLY rate of wages, should we divide the wages by 26 or 27 (exl. SUNDAYS) OR 30 or 31 (Incl. SUNDAYS) depending on the no. of days in that month ?

Kindly advise.

for calculating wages per day, the salary/wages of an employee should be divided by 26 irrespective of status, whether is is daily wager or monthly rated employee.

There is no occasion to divide the wages by 26 or 27 in either case for the purpose of disbursement of wages. If a person is engaged on daily wages bases means his daily wages is already fixed then you have to multiply it by days he worked and similarly if a workman did duty for a full month irrespective of its no. of days (excluding sundays), you have to make payment of already decided full one month salary/wages so there is no question of any deduction.

Concept of calculation of daily rate drives from Payment of Gratuity Act, 1972. Where gratuity has to be calculated as per the rate of wages/salary per day, Which is salary of a month divided by 26.
