There was interreligion where boy was muslim & girl was hindu,a male baby was out of wedlock,girl left her martimonial home on the istigation of her parents & they abused to the boy & his family on the basis of religion,boy filed application to the police authorties but nobody heard him,now he want to file complait to the magistrate u/s 295A,can he file case under this section,& case of guardian for his son who is 2 month old,he also want to file RCR case against his wife,all these above noted remedies suggested by advocates.kindly suggest us are these remedies available for us,girl filed case u/s 125 crpc.plz guide us

Husband can file complaint with police under section 295A as suggested. Similarly he can also file RCR but the guardianship of his child cannot be given to her.

In the present circumstances the boy should not take any adverse legal steps, the matter may be complicated. The matter should be resolved through negotiations and meditations.Maintenance case filed by his wife stands always maintainable.

Yes he can file a private complaint in the court, but the advise given by the Khaleel Ahmad is right.

Though largely I agree with Mr. Khaleel Ahmed, but some pro-active steps are required.
1. You should file for Child Visitation.
2. You should guard against 498-a/ DV and other laws.
