hi ,
i wana know that if some one gives his shop/room for rent to some person on an agreement of 11 months n after that he again sign the same agreement for next 11 months consecutively for the same party ,will that party become the legal owner of the place he has been paying rent for? if yes then what amendment one can make to remain wholesomely owner of his place n tendent remains tendent.
M.Sheik Mohammed Ali (Expert) 22 December 2011
write the new 11 month agreement,
Deepak Nair (Expert) 22 December 2011
Agreement for 11 months is usually a Live & License Agreement to use a shop/room does not create any interest/right on the person using it on rent other than the right to use the premises for the period of agreement. The property remains that of the owner itself.
As a precautionary measure, you shall include in the agreement the clause which says that this agreement shall not create any interest/right on the lisensee on the licensed property.

Mr. Ajay Sethi and Nair could you give format of the leave and licence agreement.
Devajyoti Barman (Expert) 22 December 2011
Whatever be the period of tenancy, the tenant never becomes owner of the property nor can he dispute the title of the landlord.
Raj Kumar Makkad (Expert) 23 December 2011
A tenant is always a tenant and he cannot become its owner until he purchases the shop by paying its sale price to the actual buyer and get registered the sale-deed thereto.
Raj Kumar Makkad (Expert) 23 December 2011
Had this been the procedure to change the ownership, everyone in the world would have become owner of each and every property and real owners would have committed suicides.
Deepak Nair (Expert) 23 December 2011
Dear Mr. Mohammed Ali,
The format for L&L is highly available on internet. You can find it by google. But, i too can provide you the format if you give me your e-mail address

Tenant can not become owner but once one year period is crossed and there is continued possession by the person , the repeated LL and agreements can not bar regular tenancy rights.
Sailesh Kumar Shah (Expert) 23 December 2011
there is no law, which say that paying rent by tenant, is become owner.

Tenant always tenant unless he purchase the property.

prabhakar singh (Expert) 23 December 2011
Any one who enters in possession of property by consent of the owner can never claim ownership,i wanna tell you.Even in the mode you are continuously extending is not affecting your ownership. An improvement may be giving a break of a day or two.
jeevan1950 (Expert) 23 December 2011
please execute new agreement and dont try to save some money that can be dangerous n may create tenency rights
