Cross examination & discharge petition

One of my client is accused in stolen Railway property case. other accused filled Discharge petition before Magistrate.instead of deciding petition on oral argument he asked complaint (police inspector ) to lead evidence. prosecution leaded evidence. Now as per Magistarte oral version he will allow us to cross examine once . if we cross examine PW1 now he will not going to permit to cross in main case . if are not going to cross examine in DISCHARGE PETITION he will allow us to cross examine in main case . Can we cross examine both times ? Any supreme court & High courts judgment are there that accused counsel can cross examine in such situation TWICE ?

How can cross-examine happen in Discharge Petition?

There is something amiss.

I hope it is not that not that your discharge petition has been decided/ rejected/ kept as it is and it is the main case is going on.
