Sec 24 - working lady

Guest (Querist) 28 December 2011 This query is : Resolved
I have applid for divorce. My wife has applid fr RCR and Section 24 and litigation expenses. But she is hearing more than me. I have a xerox copy of her payslip. I produced that i court. But she has given statements in next hearning that "that is not her payslip. I was working earlier but since my husband mentally tortured me, I was not able to work and I resigned my job" . But I am sure that she s still working there.
How to proceed fr it?
Note: we dont have kids.

if she is resigned from earlier company then produced the resignation letter from her, and you may made application before the court that for verification for that company she is working or not.

If you could not prove that she is still working you can not avoid alimony.
However insist on strict proof of resignation and her income tax returns.
Deepak Nair (Expert) 28 December 2011
You can ask for proof of resignation, such as resignation letter duly accepted by the concerned authority, relieving letter, statemetn of full and final settlement of accounts after resignation. You can also ask for calling the authorised person from her office to prove her contentions.
A letter of resignation on its own is not sufficient. She shall prove the actual resignation by producing acceptance, relieving letter and full and final settlement.
Further you can ask for production of the bank records of your wife to prove her income.
