Special marriage act 1954

Guest (Querist) 14 January 2012 This query is : Resolved
One of my friend has married under special marriage act in the month of april2011.His wife had applied for nullification under section 25.

1)He has made a mistake in the notice in the occupation field of him and his wife's.

2)will the notice of the marriage reffered in the nullification case.

What do you mean by ' notice'?
The summons of the suit does not need mentioning those information.
If there is mistake in the plaint of the suit , you can not apply for amendment of pleading.

Ld. Mr. Barman,

It seems the notice issued prior to solemnization of marriage is being referred.

In which, we would need to know what was the wrong information provided.

Is it?
Then he can make provide correct information in his pleading.
The notice may not be of much importance.

i think question is not clear as i am not clear what is NOTICE
Sailesh Kumar Shah (Expert) 14 January 2012
Since, there is no provision in law to issue notice, then there is no meaning of only occupation wrong.

The mentioning of wrong address in the married proceeding is not a valid ground seeking nullification of the marriage.

It seems to be a imaginary question.
