sir i am working as appellate authority under RTI act. The applicant has sought informtion "please provide me cirtified copies of the Bank's annual balance sheet for the period 1991 to2011.
The CPIO has denied to furnish the same havieng disproportionately diverting resoreces of the bank under sec 7/9.
please guide me whther i have to furnish the same or concure with the advises of CPIO? regards

The balance sheet of the company is not a confidential one. It has to be sent to every shareholder. It can not get exemption under the RTI Act.
I suggest you to provide the info.

balance sheet must already be with bank and how does furnishing the same requires diversion of resources? balance-sheet is not a document which the PIO has to prepare specially for the RTI applicant by diverting resources.

You should deny furnishing this document because this is confidential having business secret and moreover the document of such old period cannot be provided.

Mostly PSU bank is listed in stock exchanges, so one can download balance sheet from NSE/BSE. So, no need to deny, if your bank is listed one.

As mr arunagiri's view is correct. The balance sheet is alredy published in news paper and distributed and ciculated among all share holder . What reason you need it. You can write and get the same

As Appellate authority,you can direct the PIO to furnish copies on payment of charges and dispose the matter.

the security classification of the document is not relevant.
