Regarding procedure for getting charge-sheet copy.

Hi experts,
I m very confuse because three months ago, A by-name FIR u/s 302 and arms act lodged against my uncle and his son by a victim family member. On the bases of that FIR police arrested my uncle and his son but after seventeen days investigation they found and announced innocent by SSP(Punjab police) through press conference, Two real criminals had been arrested who performed actual offensive event and weapon of offence also seized from them. SO Police made case against these criminals also file charge-sheet against them. My uncle and his son have been released on same day by Punjab police. I just want to know two things for our future protection: (1) we want to get a copy of upper mentioned case charge-sheet (challan). Please tell me from where and what is the procedure to get challan copy?
(2) Please also tell me, how can we cancel FIR i.e. lodged against us in police station? The complainant also give that statement to police I lodged FIR only on suspicion but i found truth now.

1. Charge sheet is available only when the Police after completion of investigation submit it in the court.
In your case first check whether the Plice has done so or not. If yes then apply for certified copy from the court.
2.If the Police submits Final Report against them then you need not cancel the FIR.

Hello Experts,
i m glad to receive yours answers now i m feeling free. As you said, first check whether the Police has Submitted challan in court or not.Sir police has been put challan in court. Respected sir in the quest of challan copy we need to know case number but police is not telling case no. to us since they wanna money from us, so Plz tell me:
(1) How can i know case no. of required challan, if police don't do that?
(2)Does charge-sheet(challan) contains whole investigation and statement of complainant and others?
(3) From where and how can i get copy of police final report that has been submitted in the court against actual criminals?
(4) Does charge-sheet(challan) contain police final report?
(5)Do I need lawyer for getting certified copy of challan and police final report from court?

Calm down, if you are the accused, you would get summons and the copy of the chargesheet would be given to you free of cost.
