Right to property

(Querist) 09 February 2012 This query is : Resolved
We are 3 daughters and three sons. My father died intestate for his self acquired property. We want to dispose of.

My question is whether our children (All majors) need to sign the sale deed? Can they object we sons and daughters to sell property?
Advocate Bhartesh goyal (Expert) 09 February 2012
You all brothers and sisters can rightfully dispose the property of your late father.there is no requirement of signatures of your children on sale deed.
Raj Kumar Makkad (Expert) 09 February 2012
Each one of you 6 brothers and sisters have equal share in the property (I presume that you mother has also expired). None can sale more than his share in the property so if entire property is to be sold, each one has to sale his property and accordingly his/her signature on sale-papers are required.
