Bigamy in muslim

Dear All,

as per the law of india is Bigamy is allowed in muslim without the permission of first wife?

secondly if 498A case is in court can i opt for second marriage if first wife denies to come, but i don't want to give divorce from my side. please reply me

Yes, you can legally get married. But this would a ground for the wife to seek divorce on this ground.

I would reuest you to consult fatwa-alamgiri. (I have not read it so I cannot elaborate the provisions thereof)

But by second marriage certain ly you cannot avoid criminal liability under 498a

1. Polygamy is TOLERATED and not encouraged by Islam.

2. You can marry.

3. It would give your wife right to live apart and seek maintenance.

4. Getting second wife is cruelty enough for above purposes.

5. Would give additional fodder to her 498A cases and won't help you at all.

ADVISE : Get out of this mess before you do marry again
