First clarify
1. Whether you are the co -sharer of this property?
2. If yes then whether the development agreement has been executed in your exclusion?
If these happens then you can file a suit for partition and for injunction.
If no, then point out in detail how is your brother depriving you.

the question is how you are connected to the said estate.
whether your brother was married or not....who are the actual legal heirs to inherit his assets at this state etc. all are factual questions.
better get in touch with some local lawyer and follow the remedy as the circumstances invite.

Dear Lalit,
First ascertain whether the development agreement was registered,if so,you can get a copy of the agreement.Whose land was this 42 acres? Was it left behind by your father? If not what way are you claiming a share? Was it your deceased brother's self acquired?
Answer the above and we can come out with the apt advice.

mr barman raised good points, What way you are being a part of agreement? need more details. If you are part of agreement then you can file "suit of partition and injection

Unless you show how you are connected with the deal, or whether you are the legal heir, you have no locus.
