Regarding motor accident claim where licence of driver was expired

(Querist) 23 May 2012 This query is : Resolved
DEAL ALL I MET WITH AN ACCIDENT ON 5/2/2011 AND MY LICENCE WAS EXPIRED ON 29.10.2010. MY INSURANCE CLAIM WAS REJECTED STATING THAT MY LICENCE WAS EXPIRED ON THE DATE OF ACCIDENT. IS THERE ANY JUDGEMENT OR RULE IN THIS CASE THAT INSURANCE CLAIM CAN BE REJECTED OF THE INSURED VEHICLE? I NEED HELP IN THIS REGARD. THIS IS THE CLAIM OF PERSONAL VEHICLE AND NOT THIRD PARTY.

Dear UK singh
It is the terms and condition of the insurance policy itself, for judgement and case law you can search through indiankanoon.com
feel free to call

yes without the active license a person met with accident by his self driving is punishable, so according the basis of law the insurance authority rejected the claim.

the insurance company is perfectly justified in rejecting your claim . you did not have any valid licence at the time of accident . the insurance company is not bound to pay your claim .

Agreed no claim.
