SIR,
MY QUERY BEING DOES THE COURT TAKE THE SAME VIEW ABOUT ONE ENCROACHING GOVERNMENT LAND AND ONE WHO ENCROAHES INTO COMMON AREA OF APARTMENT/ OR ONE WHO ENCROACHES INTO SOME OTHERS LAND.

Encroachment is encroachment, whether it is Govt property or private property. In the case of Govt property, it can get quick eviction of the encroacher by taking action under the Public Premises (Eviction of unauthorized persons) Act, 1971. In the case others they will have to approach the civil courts, which may take more time to get relief.

Law would be the same in the given three situations. But if you encroach the neighbours property, you have to expect immediate action from him; in other cases, you may continue until some interested persons object and take legal action to rectify.
