Expense incurred to fight a case in apartments

Sir,
Our apartments which are seven years old does not have a registered association.
Now, One of the apartment owner has built an illegal extention of their duplex house by encroaching into an area to which they do not have title.
Four of the apartment owners approached the High Court and the case is pending.
My question is whether the expenses incurred to fight the case is to be borne by the four owners who filed the case or should it be shared by other flat owners.

Sir,
Three are absentee owners, one is related to the person who made the encroachment and another flat owner wants to do the same to his apartment and is waiting for the orders of the court, in such circumstance there cannot be a collective fight.
