Distribution of land

(Querist) 09 June 2012 This query is : Resolved
Hi Sir,
I am Punita Parnami. My grand father has 5 sons. He has a house and 12 acre land. He has distributed his house among his sons. He has not distributed land. But he has written in stamp that up to his life time he is free to sale, donate and use the land and no son will have any objection for this. After his death remaining property will distributed equally among all the sons. All sons have signed this stamp.
Now my question is if he want to distribute his land among 3 sons in his life time or if he will sell land to these 3 sons or register land by the name of these 3 sons in his life time, can other two sons take objection in this after his death. Please let me know....

will takes effect on death of your fran father . during his lifetime grandfather can sell , gift property to his 3 sons or any one else as he pleases .

the will which he executed on stamp paper can be revoked by him . he can make a new will . it has t be signed in presence of 2 witbesses . need not be on stamp paer .

From your question it seems that the land is absolute property of your GF and he has made Will, yet he can do anything with that land during his life time.

yes, he is still having right to dispose of his property as per his own wish if the same is his self acquired property.

will comes into effect after the death of the testator....but in the given case if the partition is done during life time and the share are determined then the previous document containing other intentions will become waste.

What is the nature of the proeprty? If it is the self-acquired property, Grandfather is free to do whatever he wishes with the property.
