Need advice

(Querist) 11 June 2012 This query is : Resolved
we just want to prepare some legal document where we can disclosed that our parents has not give any money. They have their will and choose to give money whomever they want. Looking at today's greedy people, i don't want to take risk if soemthing happen to my parents, I don't want my sibling to run behind me saying mom and dad were living with you and they gave you x amount of money for something. I just want to secure my side, they are living with me in UK for their own immigration stuff and they haven't given anything to me.

Can anyone suggest which route do i need to take for this process ???

Let your parents make a will of their property. They can give their property to anyone they so desire. That should suffice.

I will ask my parents to make will My parents has not given me any single cents out of their income. Me and my husband living happily in UK. We have our house in india (which we bought with our hard earn money) and house in UK too.

but i just wanted to make sure , my sibling doesn't file law suit against me saying " dad has give you so much amount of money to build house in india or any other invesetment we have " which they are capable of doing so :-).

Do i need take any precaution and have legal document ???

such law suit will not stand.

Neither you nor your sibling has any right in the self acquired property of your father unless it has been bequeathed/gifted. If your father gives you money to make a house in India, or for any other investment, your sibling cannot object to the same legally. However, in the event of your parents giving you any share in their property by way of a will, he may challenge the same.

there are no reasons to be afraid of the things.

the Will will be a sufficient document....the property which is self acquired cannot be put to challenge by the other siblings.

even if you creates some unilateral document that your parents had not given you anything, it will be of no use.

Let the will be clear and registered in the presence of witnesses.

You need not to be tense out of the things.

Thank you for answering my query. I just want to make sure, I don't get in any legal battle :-) I will have my parents make will and state in will everything.

You can get an affidavit from your parents stating and affirming that they have never given you anything or whatever you want them to state to your satisfaction & then get it notarised. It should suffice.

I agree with Ld. Ganguly.

In any case, whatever they gave out of their free will can not be disputed by anyone.
