Regarding challan if no dl

Dear Sir

I have a Omini Car (Commercial Vehicle). RTO has challaned as no Commercial Vehicle Driving licence. s.177 and 181 allow max 500/- penalty as per MVA 1988 but RTO sought Rs. 1200/-. Is it ok if yes please provide me act and rules.

sec 181 of mv act states " whoevr drives a motor vehicle in contravention of sec 3 or sec 4 shall be punishable with imprisonment for a term which may extend to 3 months, or with fine which may extend to 500 rupees or with both ". sec 177 is irrelevant to the case

Dear Sir,

You are right but RTO for this offense made penalty for Rs. 1200/-. Can you provide me any amendment pertain to this section where Rs. 1200/- is showing for the same.
