Will case

(Querist) 26 August 2012 This query is : Resolved
My query:
(1)can a single witness is sufficient to prove the will case?
(2) importance of second witness in will case?
Dr J C Vashista (Expert) 26 August 2012
Is the testator alive? If yes, it is a piece of paper.
Whether the will is registered?
If yes, No
otherwise one of the surviving witness is sufficient.
Devajyoti Barman (Expert) 26 August 2012
1. Yes
2. Vital if he controverts the genuineness of the Will.
Adv Archana Deshmukh (Expert) 26 August 2012
Examining a single witness is also sufficient provided his testimony is unshaken in the cross examination.
R.K Nanda (Expert) 26 August 2012
1.No.

2.Both witnesses have equal importance.
prabhakar singh (Expert) 26 August 2012
Attestation is required by two witnesses but
it can be formally proved in court by any of them.
Unless his testimony is damaged by cross it is always better to produce only one to avoid
contradictions between two.
