Gurdianship of a minor

(Querist) 28 August 2012 This query is : Resolved
Sir,If a Hindu man Made a Will in Favour of Minor Daughter and apoint Gurdian Her uncle(Chacha) instead of Her Mother,What is the Legal Status about gurdianship
Adv.R.P.Chugh (Expert) 28 August 2012
If a Hindu male dies and in his will appoints a guardian (legally called testamentary guardian) however his wife survives him, then in that case the wife would be the legal guardian, and if she dies without a will the husband's appointed guardian would revive or she may also appoint a new guardian as per her will. This is the position as per the Hindu Minority and Guardianship Act.

Hope that helps !

Adv. Bharat Chugh
