I want to file the writ petition for quashing of FIR and subsequent proceedings relates to 498-A/406 .Also I cam e to know that girl has got her MLC at some hospital in which no apparent injury was found..It clearly states that she has made it with wrong motive inb order to implcate my family

For filing writ petition can I/WE make pray to initate criminal proceddings against the Complainant by making false frivolous complaint and subsequent acts by impleading hospital as party

Who you are in this case,?
what was the MLC?
Has only physical cruelty been alleged or mental cruelty has also been alleged.
Raman (Querist) 10 September 2012
I am one of the accused made by the complainant..MLC was fake made by hospital in which no apparent injury was stated
Sudhir Kumar, Advocate (Expert) 10 September 2012
Are you as accused, aggreived against the hospital for preparing a fake MLC with zero injury by hiding the real injury caused by you?
Raman (Querist) 10 September 2012
Mr Sudhir Kumar, It is very shocking to learnt from your responses..This is not forum where you can made hypothetical statements which puts salt on the wounds of the parties who require expert advices.. it may creates amusement for you but I suggest you to find another forum where you can make lot of fun as this forum is not for making jokes

well if there are disputed questions of facts then HC may not interfere in the Quashing proceedings, in fact all depends upon the facts and circumstances of the case.

you can summon the concerned hospital at the time of evidence during trial.

Quashing petition has a very limited scope thus to be dealt with very carefully.

Sudhir Kumar, Advocate (Expert) 10 September 2012
No it is not a joke. If you are accused and the complainant as per MLC (as stated by you not hypothetical) has no injury then you should be happy that charges are likely to fail.

If allegation is fo mental crulity then physical injury may not exist.

Or else you may be very kind to disclose full facts so that this charitble forum could give you some advise on the issue.
