Share in father's house

My wife got 1/3 share in father's(not physlcal) propertyas per hsa 1956 but not in dwelling unit as sec 23 was alive nowin 2005 amemndment sec23 omitted if I am right. My qerry is now can I asked share in fathers house as same on her elder bro name who is denied to do .pl advice. There is no will, records etc. Property is in ratnagiri maharashtra. Thanks

why are you concerned for your wife property? how did property come in her elder brother name did your wife submit any NOC on death of her father?

Either your wife has signed on relinquishement deed or NOC in favour of her elder brother after her father death then why you are much concerned about your wife property.

There is one mistake in my query that I have to say she can asked instead of I.further she has not given any noc/rellinquishment letter etc.to her brother.(they are 3
2 sis & 1bro) I am not concern with her property but
as husbund I have to run here and there foradvice.

if that is so then how has property been trnasferred in brother name after death of father . please cross check your facts . in absence of your wife NOc property would not have been trnasferred in her brother name
