False crpc125 and 498a.

(Querist) 05 November 2012 This query is : Resolved
Dear Sir,
My mother and me both r trapped in false 498a and i m still fighting my case. in crpc 125 case i have been ordered RS 1700 per month as an interim maintenance and also she is working in some private firm and getting a salary of near about 15000 per month so i wrote an application to that firm to give some information about my wife but they refused it.so i want to know is there any other way to get the information like video recording or file some cases against her telling the court that she is lying, that she is jobless and cannot maintain herself and her kid and then police can investigate the case and get me the information i need.

You may try but try to fats-track the maintenance case so that when trial begins you may summon the company official to ask questions on her employment.

Yes, u can summon the Employer to give evidence that she is earning salary of 15k.

Agree c Mr. Barman
498 u hv to defend.

thanks sir, but under which section i should file the case and where to file the case, in the court or police station ?
i mean what do i say to my lawyer to do, b coz he has not given any idea about this.

make an application before the court wherein your 125 case is pending .
Raj Kumar Makkad (Expert) 06 November 2012
You cannot file the desired case either at police station or before court but can definitely get issued notice from the court to that employer where your wife is working so that relevant record of employment of your wife may be produced and thereafter you shall be able to file a criminal complaint under section 340 of Criminal procedure code against your wife for making false assertion before court that she is unemployed.
