Tenancy rights

(Querist) 14 December 2012 This query is : Resolved 
I am a landlord and have few tenants in Mumbai.

I want to know the legal provision if a tenant passes away and -

1. The wife and two sons are alive. They want to transfer tenancy on the name of the wife.(with all's concent)

2.The wife, 2 sons and 3 daughters are alive and want the tenancy tranfered in the name of one of the son.(with all's concent)

3. There is no immediate heir (no son or daughter) and the tenant is staying alone.

The tenancy is in the name of the mother who dies leaving behind 2 sons(staying together) and 2 married daughters. The sons are both wanting rights and want both names mentioned in the transfer.

If there is a written agreement between land lord and tenant, in the event of the death of either party as the terms and conditions of the deed executed all the rights and liabilities shall be tranfered to the heirs of the deceased immediately.

You are a big landlord having various properties on rent so you can easily afford the services of local lawyer to advise you on all such aspects leading to tenancy of your properties.

All the properties are a 12 X 10 rooms. Also as mentioned, the income is only at the time when there is a relinquishment of right of tenancy. In all the above cases there is no such luck.
