Land lord rights

Dear sir/Madam,
i am a tenant in an building in Mumbai.which is recently re-constructed by all the tenants funds. landlord has not provided single penny for re-construction. my problem is that i owe a room with my brother's room adjacent to me,and we have decided to remove the middle wall and make it a single room,for carrying out business activities from there.but the landlord says that we can not have the rooms joined and he is asking money for that. please help what can i do and how can i fight him legally.

If your room and the room of your brother are separate units then legally you cannot join these units hence if landlord accepts your desire after some adjustment, let it be done

Sir, what if we go to structural department in BMC.

If BMC permits you then nothing remains to be added more. BMC shall not oblige you without the permission of landlord as per rules.

From what u have stated in the query, it appears that even after redevelopment all the tenants continue to be the tenants of your landlord even though all of u have met the cost of redevelopment. Therefore if u make any structural changes as proposed without consent of ur land lord, it will give a ground to the LL to file a suit for eviction of both of u for making unauthorized structural changes. Even BMC will not give u permission without the consent of the landlord.
