Impounding an unregistered and forged document

(Querist) 21 December 2012 This query is : Resolved
Sir,

What is the result for unregistered and forged document impounded for stamp duty. The litigant holding the unregistered and forged document can become valid and legal after paying penalty and stamp duty. Can the litigant will hold title or interest on the suit property by merely paying stamp duty even though it is forged document.

Please kindly advise.

A forged document cannot become valid merely on paying the stamp duty or penalty thereon. Forgery and non payment of stamp duty are two distinct issues not inter-connected.
