Fir and all proceedings quashing!

(Querist) 10 January 2013 This query is : Resolved
My learned Counsel told me that if you make a ground in your petition that –
“That all the allegations of the Complainant are false and the Petitioner denies all the allegations.”

Then your petition for quashing will be dismissed in limine.

Is this contention of the Counsel is correct?

Suggestions Please!!!

is that your only ground for quashing? if so then your counsel is correct
mohanlal (Querist) 10 January 2013
No! this is the first ground amongst others.

Mere writing this ground can not be a ground for dismissal.
I absolutely do not agree with your counsel. We regularly make such ground.
ajay sethi (Expert) 10 January 2013
well then your counsel is wrong

I don't become agree with your lawyer. Such language is commonly used in almost all replies/counter affidavits and courts have to see whether it is wrong or write.
