Need remedy

(Querist) 20 January 2013 This query is : Resolved 
If, the plaintiff got cheated by an advocate, by not properly guiding him in his case , can that plaintiff file a petition in Court directly , stating that he himself conducts his case , without aid of advocate ?
Under which provision of CPC, such petition should be filed ? If, not what are other options open to the affected plaintiff?

have you give vaklatnma to your advocate ? if you have not given vaklaltnma then you can file suit in person . not necessary to engage a advocate . however it is laways better to get suit drafted by lawyer , engega lawyer to argue on your behalf as you may not be aware of legal intricacies

Party to a case has rights to represent himself under "right to be heard " and this right can be exercised by an agent also who as per law should be an advocate.Then it is party's wish to chose whether to pursue or contest personally or through an agent.In case an agent option is exercised then such agent must be an advocate.
