For love marriage

My girlfriend went home 17 days before. She never contacted me after(which never before happened). Her mobile is switched off since 7 days. We are in livein since 2 years. We both love each other a lot. We decide to get married this year. When i called her home, nobody allowed me to talk to her. We are living in two different states. What should i do?

It is better to solve your problem with the help of your family members. Inform your love matter to your parents and let them meet the parents of the girl.

Where the hell i wrote she doesnt want to marry me? They are not allowing us to talk. Plz read my que first. I want to know what should i do legally. She is 28 n i am 27. I m from a very well educated modern family. But her parent are like khap mentality village people. Mutual understanding cease to exist. all her dress goods certificates everything is here with me as i told before we are in live in since 2yrs. one more is it illegal to marry a engaged girl. to be more precise can we marry legaly if her parents forcefully engaged her. do engagement ceremony have any legitimacy. should i go to police. girls parents are like filmy high profile type zamidar n of high political influece in there area i.e, bihar.

In the given matter, you should try to personally or through any reliable person contact her by visiting her place of residence. Engagement has no legal meaning in the eye of Indian law.

Mr Barman gave suggestion s per best of understading and the apprent facts and you reacted "Where the hell i wrote she doesnt want to marry me?" Such reaction is not welcome in this forum.


There is a need to tell you that this forum is a charitable activity. It is better for you to go to some lawyer's chamber, pay his fee and learn that there is no law in your support.


Mr Buarman stated that you cannot force her to marry you. What were you doing for the last two years. had you done marriage you could have had a lot of legal support to recover her. Now you have no law to support.

It is only she who can approach police against her family. If she is aggrieved against this marriage.


But from the given facts it appears she has no grievance.

Personally!!! I had never ever visited her state before. Nearest railway station is 100kms as she told me before. Not a single contact over there. I have her postal add. I dont fear from even going there. But without any legal backup...never...i dont trust local police of her area. Practicaly i m not a movie hero. Going there is an important option but not without any backup. I am thinking to visit local police station where we use to live.

Police can do nothing in this matter because there is no legal issue involved in this matter.

Sorry for my words. I m just tensed. I havent slept two nights. This tension is taking toll on my nature. I m here for solution n not to offend any one. And plz dont say that what were we doing since 2 yrs. I m not here for condolence or for what should i do at past. Never cry on a spilt milk. N for marriage...it is nothing more then formality for me. I hate rituals. I want to know what should i do now. Dont get offended but exept a single view which seemed useful rest are giving demotivating feelings rather than solution.

Raj sir but it is illegal to deny constitutional right to live...i.e...right to choose spouse...article 21. Sir what do you expect me to do. I m 100% sure girl is with me and under pressure, getting forced, held in her house against her will. She told me that she will be back in a week. But now 17 days passed, her cellphone is off. No contact at all. This never happend before. Plz a final advice.

If you believe the girl has not been brain washed but not contacting you just due to fear of parents and when time comes she shall speak in your favor then file a writ of habeas corpus in the High Court on the ground that she is major,and your fiance and want to marry you but her parents have wrongfully confined her.Her parents shall be ordered to produce her before court which shall record her statement and if she speaks
to go with you,court shall order her to go with you.

Without having any information about your girl friend, you cannot anticipate that she is under pressure and accordingly cannot seek the help of police. It requires solid proof that she is under 'home arrest' of her family against her wishes. If the same is established by way of any source, you can definitely can take help of local police or even of High Court of Patna.

We have lots of photograph together. Few photographs of us she wearing sindur. Our flat owner. Flat's rent agreement is on her name but lpg connection in my name of same address. Many similar small things. What about contacting any ngo or similar orgs. I m totally confused. Its all my mistake. I should have married her long before. Let me see now. I will give my 100% bring our life back. What a man is a man who can't help her love when she needs him most. Resolved!

You have to filed a complaint before SDM/DM u/s 97 of Crpc
97. Search for persons wrongfully confined.


If any District Magistrate, Sub-divisional Magistrate or Magistrate of the first class has reason to believe that any person is confined under such circumstances that the confinement amounts to an offence, he may issue, a search-warrant, and the person to whom such warrant is directed may search for the person so confined; and such search shall be made in accordance therewith, and the person, if found, shall be immediately taken before a Magistrate, who shall make such order as in the circumstances of the case seems proper.

98. Power to compel restoration of abducted females.


Upon complaint made on oath of the abduction or unlawful detention of a woman, or a female child under the age of eighteen years, for any unlawful purpose, a District Magistrate, Sub-divisional Magistrate or Magistrate of the first class may make an order for the immediate restoration of such woman to her liberty, or of such female child to her husband, parent, guardian or other person having the lawful charge or such child, and may compel compliance with such order, using such force as may be necessary.

Section 97 & 09 wont work in your work as suggested by Nadeem.
