Construction of building in the adjacent plot.

(Querist) 08 March 2013 This query is : Resolved 
Dear Advocates,

My client had purchased a plot in "X" Nagar, Whereas, another person purchased a plot in the another nagar called "Y". But, both are adjacent Layouts.

A person purchased plot in "Y Nagar" started construction in both the plots including of my client.

What is the remedy both criminal and civil may be useful to my client?

Kindly advice.

file suit for declaration that you are the owner of said plot and for injunction restraining third party from carrying out construction in your plot .

file police complaint against the third party for carrying out construction in your plot . also complain to muncipal corporation that illegal construction is being carried out and you have not made any application for carrying out construction

Lodge a complaint to the Police and local Municipality then file a suit for Injunction and Declaration in Civil Court.If the Injunction is not granted by the Civil Court then aggrieved person can file a Case u/sec.144 of Cr.P.C. in Magistrate Court.
