hi, i have bought a shop for my own requirement in jaipur rajasthan which is under tenancy by previous landlord since 1984 and the rent is only 1500 rupees.so i can say that those people are not my tenants. i have given them a notice stating that i have bought this shop for my own purpose so please left that property. but they are not ready for the same. what should i do in this condition? please help....

They are indeed tenants for which you have to file suit for eviction.

As you have already served a notice to the tenant, now file an eviction petition before Rent Controller of your area. The sole ground of personal necessity is the best ground seeking eviction.

thanks experts for the response. my next question is- if i file an eviction suit then how much time will it take for completion of the whole process? and what about the rent? will the rent remain same or it will increase according to the present market rent which is 20000rs p.m. during judiciary process as i am a new landlord. i want those shops anyhow... plese help!!!

1) Your problem seems to be that you need rent increase from 1500/- to 20,000/- which is not permitted in your state rent control act.

2) There are very limited scope even for eviction for personal use unless you can prove than the tenant has other suitable premises.

YOU SHOULD TRY TO MAKE PERSONAL SETTLEMENT OTHERWISE FOR ANY MEANINGFUL RELIEF FROM THE LEGAL SYSTEM YOU SHOULD BE READY TO GO UP TO SC AND THAT TOO WITH EXPERTS IN THE FIELD.
