Hello,
I had a query yesterday and got some good reply. To a drill down to my query further:
1- My client is an LLB graduate and was earlier practicing in a dsitrict court.
2-He is currently working as a teacher in a private college which is affilaited to State university.
3-Due to pending case, my client is defending an ancestral property civil case (Title Suit) in the district court. The property belongs to his mother who has given him a General Power of Attorney and it is registered.The PoA specifies that he can represnt his mother in a court on her behalf as mother is 70+ years with health issues.
The query is
a)As he is working in a private affiliated college and also defending his mother's case, is it legal to represent his mother's case?
b)Is it a case of double employement?
c) If his defending the case is legal, then under what CrPC, CPC section can he continue to teach in a private college and also defend his mother's case.

Dear Nilu,
There are decisions to the effect that (i) an Advocate can be a part-time teacher/lecturer; but (ii) a full time teacher cannot practice as an Advocate.
Therefore, your friend who is an employee in a College (private or public does not matter) he is not entitled to practice as an Advocate.
Your other queries (b) & (c) need not be answered separately.
