For under trial is maskaat necessary?
We went to meet my brother he asked for money to pay for not doing maskaat.
He told jail police, barrack incharge all will take share from money which he will receive.
Is all this legal?

ANSWER: NO!all this is not legal.
"Masaqaat" means doing physical labor.

yes sanjay Dutt is also educated yet he has to do physical labour in jail . your educational qualifications has no relation with physical labour .

An under-trial is not expected to do labour work rather a convicted and punished person can be awarded punishment of rigorous imprisonment. Unless specific words of RI are not used in order by court, no person can be forced in jail to do it.
Many illegal practices are going on in Indian jails.

Undertrial NOT EQUAL to "Masaqaat" (physical labor)
Undertrial NOT EQUAL to "rigorous imprisonment" (RI)
Undertrial NOT EQUAL to Convict (as yet)
CONVICTED to RI EQUALS to "rigorous imprisonment" (RI)
(This depends on the offence and the order of the Court.
EDUCATED CONVICT
The Prison authorities are empowered to depute work / labour, as per the Age, education / gender, upon proper representatioin to the Prison Supritendent.
