Installation of a new electricity connection.

We have a BSES Rajdhani Electricity connection installed on the ground floor on my father's name. I think property is some kind of power of attorney/sale deed on his name. But he lives on the first floor. We along with our mother live on the ground floor and we all are of the same view. Now he creates problems for us by disrupting the power supply every now and then with a purpose to trouble us and make us leave the house. Now we want to have a new electricity connection issued on my mother's name and it is highly unlikely to get an NOC from my father. So is there any way out for us to have a new connection from BSES on my mother's name. And also it would be really helpful if there is any reference court judgement in similar kind of case.

Your mother can file a domestic violence application against your father and can demand non intrruption in power supply or NOC for a new electric connection.

It would be worth a mention here that my father has already filed a case of permanent injunction in civil court, where only I and my elder brother is a defendant. So is your suggestion still applicable? And if yes, then do we have to file an FIR for the domestic violence and then proceed for the new electricity connection or we will have to fill a case for the domestic violence?

First of all, it was incumbent upon you to post entire relevant facts at the same time secondly, I have not suggested you to file a domestic violence case rather my suggestion is for your mother. You both brothers cannot file domestic violence case against your father.
You both brothers have to defend yourself in the ongoing civil suit and meanwhile your mother can file the application as suggested.

My apologies, Sir for I am ignorant about the mutual relevance of different facts aforementioned. As my mother is an illiterate individual, so when I said we, I meant it as in we helping her to achieve the suggestion made by you.
And we both brothers are already defending ourselves in the said matter.

The article is worth mentioning. Even though your mother is illetrate, she requires help of a lawyer for the purpose of DV Act case.
