Eviction oftenant

My F-in-L, is facing a peculiar problem. With due respect to Advocates, I am seeking an advise from you to solve this issue. My F-in-L is in deep trouble due to renting a property to a Criminal & Labour practicing Lawyer.

The said Advocate did made an agreement on 01.05.2009 for 3 years. Post which when we requested him to vacate the premisis he refused and made an extension for 3 months by giving false stories.

Like this he did twice. As per schedule he was suppose to vacate the premises on 01st May 2013. However on his request, it was extended for 3rd time till 31st July 2013. He himsel gave a self declaration mentioning the same on Rs.100 eStamp paper.

Now, during last week as the date of vacating the premises is nearing, he provatively went to local Police station and lodged a compliant on my F-in-L saying that he has threatned to murcer. Advocate' intention is if he lodges a complaint on my F-in-L he can stay freely without disturbance from land lord.

The local police have called my F-in-L for informing the same. Due to god's grace, till now they have not taken serious action on this. Today again they have called him. He will be going within a day or two.

My F-in-L is a purohit. He belongs to 18th century. He do not have the general knowledge on dealing with normal people. He believes people easily and lost lots of money by way of got cheated by others.

Now on account of this he is going to depression and also expressed to commit suicide, instead of facing Police and going round to Courts. Because in his family no body went to PS not Court. He is feeling humilated by the way the tenent's behaviour.

Request the group to suggest the best solution so that it should be a win win situation to both F-in-L and Advocate Tenent.

Convince the tenant to vacate thru some mediatiors so that it will be a win win situation for both the parties. If not then consult a local civil lawyer who handles rent act cases.

Hardly there comes any win-win to either side.18th century human should not interact with 21st century men.He must have some adviser to deal every affair.Unless your FIL finds a man who can overpower the tenant in persuading him to vacate things are bound to go to court.

1) When knowing the advocate is criminal advocate you made mistake of handing over your property.

You may not be aware that normally no bank gives loans to advocates since they are aware that what ever they do there will be legal loop holes.

2) Even your tenant being advocate is not aware of his rights fully.

Now you can not evict him other wise than an order of court which may go far appeals and counter appeals.

3) In preset times old mind set does not work. Actual recording of vice and action has become simple.So avoid old tactics of even verbally accusing and may be threatening.

tenant has no intentions of vacating the property . being a lawyer he fees he can drag on for years . immediately file suit for eviction
