Dear learned experts.if a person is not giving interim maintenance as per order given by the court is it mandatory that aggrieved person has to file execution petition or the court arrest the husband without execution petition.in my dv case husband didnt paid a penny yet

if your husband has failed to comply with orders of maintenance take out execution proceedings against your husband .

sir without giving execution petition will the court take any action against my husband?actually my advocate is saying that without giving execution petition the court will not do anything.

Without execution petition, how will the court reach the conclusion that husband has not paid??? So you have to file execution petition. Trust your lawyer and do as he says.

Filing of execution petition is necessary.

Court shall pass its order of arrest etc. only on filing of the execution petition.
