How to lodge compliant in consumer court

Hi Experts,
I have been victimzed by a company called TIKONA digital networks who provide broadband solutions , matter is of last year aug-sep 2012 when i bought a plan from a tikona sales person of 4mbps committed speed (as said by salesperson) but during installation i came to know that plan is only 2 mbps and he cheated me during selling the plan.
disaster does not stop here , after having the services i have never used there services without any problem even for two hours continuously and every time i logged complaint they closed my tickets in their system without fixing the issue and asked me to re-open it which cause me great loss personally , professionally and mental agony i had to face.
When i asked their call centre executives to disconnect it , they were not ready to disconnect it as well even after continuous mails which has recorded this instance very clearly there was no reponse from higher manager's even.
finally after one month they charged me 282 rs etxra and closed the connection , my first month payment was already in advance and and i never used their services completely and they say this amount you have to pay as your usage crossed the limit of download but speed is not coming , ip is not assigned almost all the time then how the usage crossed i do not understand.
After disconnection modem and every materail is returned but i lost my money in this useless connection.
Now , After one year they are sending demand notice stating that pay the money in 3 days or we will take legal actions against you which i never told them that i will not pay ...they never called me for this amount infact their demand notice says to recover 1500 for modem which i already returned ...this is kind of torture story i have faced by TIKONA , i replied to their legal cell in mail to sort this out but like before no response .
I have paid the money however but i want to sue them for mental torture and fraud done by their sales person [i have every mail sent to them in reminders and their sales person's EMPLOYEE ID and Mobile number as well]
Please advise what is the procedure to lodge the complaint in consumer court and can i file a request for one year old case ? i have today only made the payment as i do not belong to defaulter category by nature in person but their torture and not listening to consumer complaints and fraud done is really tolerable , even demand notice contains false statements and has been prepared like a threat without seeing case history and site survey reports of discontinuing the services.

You can file consumer complaint within 2 years of acrual of cause of action. It shall be better to engage a local lawyer for filing the complaint.

First of all issue them a notice,detailing your complaint and claiming return of amount paid PLUS compensation for mental agony estimated say @ Rs 30,000/-.You should specify in the notice that they have to comply with your demand,within 15 days of receipt of your notice at their end, failing which you will be constrained to take legal action in matter at their cost and peril.wait for a month and then file a consumer complaint before the fora having jurisdiction.

You can file a consumer complaint after sending them a legal notice. Better contact a local lawyer.
