(Querist) 24 December 2013 This query is : Resolved 
We are four brothers, out of which three of us are in job and stay away from native place. Fourth brother who was staying with my 80 years old father. Since my father was not able to walk much , my brother name was included as nominee in all bank account. Now my father is dead my brother received entire amount since he was the nominee. We three brother are asking to share the money since the amount was the earning of my father. But my fourth brother is not willing to share a single rupee. My question is since my father was not able to walk much my fourth brother was included as nominee, can we three brother claim on the bank money since it was the earning of my father. Also note we are working away from our native place.

yes you can claim . nominee is only trustee for all legal heirs

Legally you are entitled.

You three remained in your service earning nicely contributing nothing towards the liability of your father, financially he needed nothing, physically your fourth brother assisted him. Morally you can decide. Though this is legal column and legally you are entitled for the share.
