Dear Experts,
My maternal grandmother will receives plots on her father's land acquired by CIDCO. Now she wants to make will in the name of her daughter ( my mother) . But my grandmother has also son who also wants his share. Can my grandmother can make will in the name of my mother or not for the plots allotted by CIDCO or not? and after making will is her son can succeed to get his share in property

was the land your great grandfather self acquired property . if so and your grand mother inherited said land she can make a will in respect of plots received by her as compensation .

If the property by your Maternal grandmother's father was self acquired property, your Maternal Grandmother can will this to your mother or any one else.

The plot allotted to your grandfather by CIDCO would be treated as his self acquired property.
In that case the same would devolve on his daughter her self earned property and hence she can give it to your mother in which her brother has nothing to say.

The property of your grandmother's father was allotted to her by CIDCO, thereby conferring title on her. This means she becomes an absolute owner of the property and it becomes her own exclusive property over which she has full rights to dispose it in any manner and to anyone she desires so which cannot be disputed. Therefore bequeathing her property by executing a Will in favor of your mother is legally valid and your uncle cannot object to this nor can he claim any share in it any time in the future too.
